1. Introduction and Acceptance
Welcome to JanitorAI. These Terms of Service ("Terms") constitute a legally binding agreement between you and JanitorAI Inc. ("JanitorAI," "we," "us," or "our") governing your access to and use of the JanitorAI platform, including our website at janitorai.com, mobile applications, and any associated services (collectively, the "Platform").
By accessing or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, Content Policy, and Content Removal Policy. If you do not agree to these Terms, you must not access or use the Platform.
IMPORTANT: These Terms contain an arbitration agreement and class action waiver (Section 13) that affect your legal rights. Please read them carefully.
2. Eligibility
The Platform is intended solely for users who are at least 18 years of age. By using the Platform, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are under 18, you are strictly prohibited from accessing or using the Platform, creating an account, or participating in any JanitorAI communities.
We reserve the right to terminate accounts and deny access to anyone we reasonably believe to be under 18. Misrepresenting your age constitutes a material breach of these Terms and may result in immediate account termination.
3. Account Registration and Security
3.1 Account Creation
To access certain features of the Platform, you must create an account. When registering, you agree to provide accurate, current, and complete information and to update such information as necessary to maintain its accuracy.
3.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized access to or use of your account. We are not liable for any loss or damage arising from your failure to protect your account credentials.
3.3 Account Restrictions
You may not transfer, sell, or share your account or allow others to access your account. You may not create multiple accounts for abusive purposes, including circumventing restrictions or bans.
4. License and Platform Access
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for your personal, non-commercial purposes. This license does not include the right to sublicense, modify, adapt, translate, reverse engineer, decompile, disassemble, or create derivative works based on the Platform.
We reserve the right to modify, suspend, or discontinue the Platform (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Platform.
5. User Content
5.1 Your Content
"User Content" means any text, characters, images, audio, video, or other materials you submit, post, or transmit through the Platform. You retain ownership of your User Content, subject to the licenses granted herein.
5.2 License to JanitorAI
By submitting User Content, you grant JanitorAI a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content in connection with operating and improving the Platform. This license continues even if you stop using the Platform, but only to the extent necessary to maintain the integrity of the Platform and preserve content that has been shared with or incorporated by other users.
5.3 Content Responsibility
You are solely responsible for your User Content and the consequences of posting or publishing it. You represent and warrant that you own or have the necessary rights to submit your User Content and that it does not violate any third-party rights or applicable laws.
5.4 Avatar Guidelines
Character avatar images must comply with standards appropriate for public display. Explicit nudity, pornographic content, or overtly sexual imagery is not permitted in avatars. These guidelines ensure platform accessibility while preserving creative freedom in character development and storytelling.
6. Prohibited Content and Conduct
You agree not to submit, post, or transmit any content that:
(a) Depicts, promotes, or facilitates the sexualization of minors in any form, including fictional depictions;
(b) Contains any depiction of individuals under 18 years of age;
(c) Promotes or constitutes human trafficking;
(d) Depicts gore, bestiality, or sexual violence;
(e) Is illegal or advocates for illegal activity;
(f) Promotes terrorism, violent extremism, or political violence;
(g) Encourages, depicts, or instructs on self-harm or suicide;
(h) Contains hate speech, promotes discrimination, or incites violence against individuals or groups;
(i) Harasses, bullies, intimidates, or threatens any person;
(j) Discloses personal or private information about others without consent ("doxxing");
(k) Infringes any intellectual property or proprietary rights;
(l) Contains spam, malware, or deceptive content;
(m) Attempts to circumvent security features or moderation controls.
You further agree not to: (i) use automated systems, bots, or scripts to access the Platform without authorization; (ii) attempt to gain unauthorized access to any accounts, systems, or networks; (iii) interfere with or disrupt the Platform's operation; (iv) harvest user data without consent; or (v) use the Platform for any commercial purpose without our prior written consent.
7. Intellectual Property
7.1 JanitorAI Property
The Platform and its original content, features, and functionality are owned by JanitorAI and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. Our trademarks and trade dress may not be used without our prior written consent.
7.2 Copyright Complaints
We respect intellectual property rights and respond to valid notices of alleged infringement. If you believe your copyrighted work has been infringed on the Platform, please submit a notice to [email protected] containing: (a) your physical or electronic signature; (b) identification of the copyrighted work; (c) identification of the infringing material and its location; (d) your contact information; (e) a statement of good faith belief that the use is unauthorized; and (f) a statement under penalty of perjury that your notice is accurate and that you are authorized to act on behalf of the copyright owner.
8. Subscriptions and Payments
8.1 Subscription Services
JanitorAI offers subscription-based services that provide access to premium features. By subscribing, you agree to pay all applicable fees according to the billing terms presented at the time of purchase.
8.2 Payment Processing
Subscription payments on the Platform may be processed by third-party payment processors, merchants of record, app stores, or other authorized distributors. Those parties may handle payment method storage, billing, taxes, refunds, chargebacks, and other payment-related functions under their own terms and policies. When you make a purchase on the Platform, you authorize JanitorAI Inc. and its affiliates, including Dulova Investments Limited (located at 10-12 Florinis Street, 1065, Nicosia, Cyprus, Company Registration Number HE 477877), and their authorized payment partners or distributors, to charge your payment method for the applicable fees and taxes. All other aspects of your relationship with the Platform, including your Content, Account, and use of services, remain governed by JanitorAI Inc. under these Terms.
You agree to provide complete, accurate, and current billing and payment information. You represent that you are authorized to use any payment method you provide and agree to keep your payment information up to date.
For purchases made directly through the Platform, refund eligibility is governed by these Terms and applicable law, even if a third-party payment partner administers the refund. For purchases made through an app store or other third-party distributor, the distributor's terms and policies may govern purchase, cancellation, and refund rights as described in Section 8.6.
8.3 Billing and Renewal
Subscriptions are billed in advance on a recurring basis according to the billing cycle you select (e.g., monthly, quarterly, or annually). Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. You authorize us and our authorized payment partners or distributors to charge your payment method for recurring fees until you cancel.
If your payment method cannot be charged, we may retry the charge, ask you to update your payment information, suspend or cancel your subscription, downgrade your Account to a free or limited tier, or restrict access to paid features until payment is received. You remain responsible for any unpaid amounts, except where prohibited by applicable law.
8.4 Price Changes
We may adjust subscription pricing at any time. For existing subscribers, price changes will take effect at the start of your next billing cycle following notice of the change. Continued use of the subscription after a price change constitutes acceptance of the new price.
8.5 Cancellation
You may cancel your subscription at any time through the billing portal, accessible from Settings → Billing → Manage subscription, or by contacting [email protected]. Upon cancellation, your subscription will remain active until the end of your current billing period, after which it will not renew. No partial refunds will be provided for unused portions of a billing period, except where required by applicable law.
8.6 App Store Purchases
If you purchase a subscription through an app store or other third-party distributor, your purchase, billing, cancellation, and refund rights may be governed by that distributor's terms and policies. You may need to manage or cancel your subscription through your account with the applicable app store or distributor.
8.7 Subscriptions and Enforcement
A paid subscription does not limit our ability to moderate Content or enforce these Terms, our Content Policy, or other Platform rules. If we remove Content, restrict features, suspend or terminate an Account, or take other enforcement action, you will not be entitled to a refund because of that enforcement action, except where required by applicable law.
9. Refund Policy
9.1 General Policy
Fees paid are generally non-refundable except as expressly set forth in these Terms or as required by applicable law. You will not be entitled to a refund because we remove Content, restrict features, suspend or terminate an Account, or take other enforcement action under these Terms, our Content Policy, or other Platform rules.
9.2 Statutory Consumer Rights
These Terms do not override any mandatory local laws regarding your cancellation, withdrawal, refund, or other consumer rights. Where required by applicable law, we will provide information about those rights and process eligible requests in accordance with the applicable legal requirements.
9.3 Defective Paid Services
If you believe a paid service, paid feature, or purchased content is defective, contact [email protected] with details. If we determine there is a defect, we will provide a repair, replacement, credit, or refund at our discretion, except where applicable law requires a different remedy.
9.4 Company-Initiated Termination or Discontinuation
If we terminate your paid subscription for reasons other than your breach of these Terms, violation of our policies, unlawful or fraudulent activity, payment failure, or other enforcement action, or if we discontinue the paid subscription service before the end of your current billing period, we will provide a pro rata refund or credit for any prepaid, unused portion of that billing period, except where a third-party distributor's terms apply or applicable law requires a different remedy.
10. Termination
10.1 Termination by You
You may terminate your account at any time by following the account deletion process in your account settings or by contacting [email protected].
10.2 Termination by JanitorAI
We may suspend or terminate your account and access to the Platform at any time, with or without notice where permitted by law. Grounds for termination include, but are not limited to, violation of these Terms, fraudulent or illegal activity, extended periods of inactivity, payment failure, or requests by law enforcement. If we terminate a paid subscription for reasons other than your breach of these Terms, violation of our policies, unlawful or fraudulent activity, payment failure, or other enforcement action, we will handle any prepaid, unused subscription fees under Section 9.
10.3 Effect of Termination
Upon termination, your right to use the Platform will immediately cease. We may delete your account and User Content. Termination does not relieve you of obligations incurred prior to termination, including unpaid amounts. Sections 5.2, 7, 8, 9, 11, 12, 13, and 14 survive termination.
11. Disclaimers
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, JANITORAI DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that the Platform will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or usefulness of any content on the Platform. We are not responsible for User Content or the conduct of any users.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, JANITORAI AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE PLATFORM.
IN NO EVENT SHALL JANITORAI'S TOTAL LIABILITY EXCEED THE GREATER OF (A) THE AMOUNTS YOU HAVE PAID TO JANITORAI IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $50 USD.
Some jurisdictions do not allow limitations on incidental or consequential damages, so the above limitations may not apply to you.
13. Dispute Resolution and Arbitration
13.1 Informal Resolution
Before initiating formal proceedings, you agree to first attempt to resolve any dispute informally by contacting us at [email protected] with a written description of the dispute. We will attempt to resolve the dispute within 30 days. If the dispute is not resolved within that period, either party may proceed to arbitration.
13.2 Binding Arbitration
Any dispute, claim, or controversy arising out of or relating to these Terms or the Platform that cannot be resolved informally shall be resolved by binding arbitration administered by the American Arbitration Association ("AAA") in accordance with its Consumer Arbitration Rules. The arbitration shall be conducted by a single arbitrator, in the English language, and shall take place in a location reasonably convenient to both parties or remotely by videoconference or telephone.
13.3 Class Action Waiver
YOU AND JANITORAI AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.
13.4 Jury Trial Waiver
YOU AND JANITORAI WAIVE ANY CONSTITUTIONAL AND STATUTORY RIGHTS TO SUE IN COURT AND HAVE A TRIAL IN FRONT OF A JUDGE OR JURY.
13.5 Exceptions
Notwithstanding the foregoing, either party may bring an individual action in small claims court or seek injunctive relief in any court of competent jurisdiction for claims related to intellectual property infringement.
14. General Provisions
14.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles.
14.2 Modifications
We reserve the right to modify these Terms at any time. For material changes, we will provide notice at least 30 days before the changes take effect via email or prominent Platform notification. Your continued use of the Platform after changes become effective constitutes acceptance of the modified Terms.
14.3 Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
14.4 Entire Agreement
These Terms, together with the Privacy Policy and other incorporated policies, constitute the entire agreement between you and JanitorAI regarding the Platform and supersede all prior agreements and understandings.
14.5 Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
14.6 Assignment
You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.
14.7 Electronic Communications
By using the Platform, you consent to receiving electronic communications from us. You agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communications be in writing.
15. Data Protection
If you are located in the European Economic Area (EEA), United Kingdom, or Switzerland, you may have additional rights under the General Data Protection Regulation (GDPR) and other applicable data protection laws. JanitorAI Inc. acts as the data controller for personal data collected through the Platform.
Under applicable law, you may have the right to: access your personal data; rectify inaccurate data; request erasure of your data; restrict processing; object to processing based on legitimate interests; data portability; and withdraw consent at any time. 16. Third-Party Services
The Platform may contain links to third-party websites or services. We are not responsible for the content, policies, or practices of any third-party sites or services. Your use of third-party services is at your own risk and subject to their terms and policies.
We use third-party services including Cloudflare for security and performance optimization. When you access the Platform, your traffic may pass through these services, which may collect certain information as described in our Privacy Policy and their respective privacy policies.
17. Indemnification
You agree to indemnify, defend, and hold harmless JanitorAI and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Platform; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any rights of any third party.

19. Illegal Content, Safety, and Reporting
19.1 Our commitment to keeping you safe from illegal content
We work to protect users from illegal content on the Platform. "Illegal content" means content that amounts to a criminal offence under applicable law, including the priority offences identified under the UK Online Safety Act 2023, such as child sexual exploitation and abuse, terrorism and violent extremism, encouraging or assisting suicide or serious self-harm, threats and harassment, human trafficking, hate offences, and fraud. The full list of content prohibited on the Platform is set out in Section 6. Where we identify illegal or prohibited content, we will take appropriate action, which may include removing the content, restricting its visibility, and suspending or terminating the account responsible.
19.2 How we detect illegal content
We use a combination of automated tools and human review to detect, assess, and remove illegal content. Our automated systems scan content on the Platform to identify material that may be illegal or breach our Content Policy, and may flag, restrict, or remove such content automatically. Human reviewers assess content that is flagged to us by users. We keep these systems under review and update them over time.
19.3 Reporting illegal content
If you encounter content on the Platform that you believe is illegal, you can report it by using the "Report" function available on the relevant content or by contacting us at [email protected]. You do not need a JanitorAI account to submit a report.
19.4 How we handle and resolve reports
When we receive a report of illegal content, we review it and decide what action is appropriate. We aim to acknowledge reports within 7 days and to take action on illegal content as soon as we are made aware of it. Depending on our assessment, we may remove or restrict the content, take action against the account responsible, refer the matter to law enforcement, or, where we find no breach, take no action. We may contact you for further information where needed.
19.5 Appeals
If you report content and disagree with our decision, or if your own content or account is actioned and you believe this was a mistake, you may appeal by contacting [email protected] or submitting a ticket through our Help Center. We will review appeals and confirm the outcome to you. Where we determine that content was wrongly removed or an account wrongly actioned, we will reinstate it promptly.

This Section, together with our Content Policy and our Safety page, sets out how we protect users from illegal content, the technology we use to detect it, and how to report it and how reports are resolved. This Section is publicly available at https://janitorai.com/term, whether or not you are signed into an account.
